Can Switching Jobs Affect Your California Divorce Case?

When a court decides the support amount for child support or spousal support, one of the main factors they consider is income. So switching jobs during a divorce can have a significant impact on the outcome. If the new job comes with an increase in pay, the court-ordered support payment amount might also increase. If the support has already been ordered, the increased salary could still result in a change to the amount you receive or pay each month. If the court did not formerly order child or spousal support payments, the increased income could create the opportunity for your ex to seek an order for support from the court.

The reverse is also true. If you switch jobs during divorce and the new employment results in a decreased income, it could result in a reduced support payment. The court could even order support payments to stop altogether.

A significant change in income is not the only factor of switching jobs during the divorce that could affect your final court order. If the new position changes your work schedule, it could also affect the amount of visitation or child custody the court awards you. 

While changing jobs during a divorce does not mean the court will automatically adjust your child support, spousal support, or child custody orders. If an order has already been issued, the court will only consider a change if they are notified by one of the parties involved. You or your ex would need to approach the court requesting a modification of the court order based on the financial change. The court would then consider arguments from both parties before they decide on the requested modification.
